A. OWNERSHIP: HOOPS owns and operates "wherethegameis.com" and owns and has copyrights on this site and all of its contents. I. INDEMNIFICATION: You will defend and indemnify HOOPS, "wherethegameis.com" and its creators from and against any claim, cause of action or demand, including without limitation reasonable legal and accounting fees, brought by you or on your behalf or by any third parties as a result of your breach of these Terms or the documents made part of these Terms by reference, your violation of any law or the rights of a third party or use of our site.
J. General: Your acceptance of these Terms and use of this site does not create a joint venture, partnership, employment, or agency relationship with HOOPS. These terms, together with those items made a part of these terms by reference, make up the entire agreement between you and HOOPS relating to your use of the website, and replaces any prior understanding or agreements (whether oral or written) regarding your use of our site. The laws of the Commonwealth of Kentucky (USA), without regard to its conflict of laws rules, will govern these terms and conditions, as well as you and HOOPS' observance of them. If a dispute arises between you and HOOPS, you agree to attempt resolution by first contacting HOOPS through the HOOPS web site to state in full detail the nature of your dispute. Once HOOPS has received notice of the dispute, it will acknowledge notice by a return e-mail. If resolution has not occurred at the end of sixty (60) days from the date of the acknowledgement of the dispute, your only recourse is resolution through binding arbitration. HOOPS will only settle unresolved disputes through binding Arbitration which will be held in Louisville, Kentucky and only after the sixty (60) days have passed from the date of the acknowledgement of the initial notice of the dispute.
K. PRESS AND MEDIA COPYRIGHT NOTICE: Press and Media text, photo, graphic, audio, and/or video material shall not be published, broadcast, rewritten for broadcast or publication or redistributed directly or indirectly in any medium. Neither these materials nor any portion thereof may be stored in a computer except for personal and noncommercial and non-profitable use. HOOPS will not be held liable in any way to the User or to any third party or to any other person who may receive information in the Service or to any other person whatsoever, for any delays, inaccuracies, errors or omissions there from or in the transmission or delivery of all or any part thereof or for any damages arising from any of the foregoing or occasioned thereby.
L. Corporate, governmental, and institutional: Users may use portions of the Press & Media Service for internal printed communications and memoranda.
